Course of proceedings after complaint is filed

Complaints against decisions and rulings (and other administrative acts) or protracted proceedings are filed with the province administrative court within 30 days via the administrative authority which issued the decision or the ruling in the last instance.

While filing a complaint does not stay enforcement of the contested administrative act, the administrative authority or the court may stay the enforcement of the act on its own initiative or at the party’s request.

After receiving a complaint, the administrative authority is required to send it to the province administrative court, with a reply, within 30 days. It may be fined if it fails to comply with this obligation.
