Cosmetics | In Principle

Production and sale of cosmetics in Poland are above all governed by the Cosmetics Act of 30 March 2001. To a large degree, Polish law implements the relevant European Union regulations. Production of cosmetics and introduction onto the market require compliance with applicable quality and packaging regulations. Permits are not required to introduce specific products onto the market, but the producer is required to register the product in a national cosmetics database operated under the auspices of hygiene authorities.

Quality and labelling of cosmetics are subject to oversight by the Trade Inspectorate and the Sanitary Inspectorate. These authorities may inspect enterprises and issue administrative decisions seeking to bring their operations into compliance with the law, e.g. by ordering changes in labelling. Post-inspection decisions may be appealed to the province administrative court, followed by a cassation appeal to the Supreme Administrative Court.
